Terms of Service for Visiontale

Introduction

Welcome to Visiontale. These Terms of Service ("Terms") govern your access to and use of the Visiontale mobile application (the "App") provided by Visiontale Studio Inc. ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using Visiontale, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Visiontale Studio Inc.

2. Description of Service

Visiontale is a mobile application that provides immersive visual storytelling experiences. The App allows users to:

  • Browse and discover curated stories
  • View interactive visual narratives with synchronized audio
  • Download stories for offline viewing
  • Customize viewing preferences (audio settings, visual preferences)

3. Eligibility

You must be at least 13 years of age to use Visiontale. If you are under 18, you must have permission from a parent or legal guardian to use the App.

By using the App, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • Your use of the App complies with all applicable laws and regulations

4. License and Restrictions

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the App for any commercial purpose without our written permission
  • Distribute, sublicense, rent, lease, or lend the App to any third party
  • Use the App in any manner that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any portion of the App or our systems
  • Use automated systems (bots, scrapers) to access the App
  • Interfere with or disrupt the App's functionality or servers
  • Upload or transmit viruses, malware, or other harmful code

5. Intellectual Property Rights

5.1 Ownership

All content available through Visiontale, including but not limited to stories, images, videos, audio, text, graphics, logos, and software, is the property of Visiontale Studio Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 Story Content

The stories, narratives, artwork, and audio content provided through the App are original works or licensed content. All rights are reserved by their respective owners.

5.3 Trademarks

"Visiontale," the Visiontale logo, and other marks used in the App are trademarks of Visiontale Studio Inc. You may not use these trademarks without our prior written permission.

6. User Conduct

You agree to use the App in a respectful and lawful manner. You will not:

  • Use the App to harass, abuse, or harm others
  • Impersonate any person or entity
  • Share content that is illegal, offensive, or infringes on others' rights
  • Attempt to circumvent any security features of the App
  • Collect or harvest information about other users

7. Content and Updates

7.1 Story Content

We strive to provide high-quality story content through the App. However:

  • Story availability may change without notice
  • We do not guarantee the accuracy or completeness of story content
  • Story content is provided "as is" without warranties of any kind

7.2 App Updates

We may release updates, modifications, or new versions of the App from time to time. You agree that:

  • We may automatically download and install updates to the App
  • Updates may change, remove, or add features
  • You may need to update the App to continue using certain features
  • Your continued use of the App after updates constitutes acceptance of any changes

8. Offline Access and Storage

8.1 Downloaded Content

The App allows you to download stories for offline viewing. Downloaded content:

  • Is stored locally on your device
  • Is for your personal, non-commercial use only
  • May not be extracted, copied, or distributed outside the App
  • Remains subject to our intellectual property rights

8.2 Storage Management

You are responsible for managing storage space on your device. We are not liable for any issues arising from insufficient device storage.

9. Third-Party Services

9.1 Content Delivery

We use Cloudflare R2 to host and deliver story content. Your use of this third-party service is subject to their terms and policies.

9.2 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, terms, or privacy practices of these third parties.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference, to understand how we collect, use, and protect your information.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of content

We do not warrant that:

  • The App will meet your requirements or expectations
  • Defects or errors will be corrected
  • The App will be compatible with all devices or operating systems
  • Content will always be available or accessible

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Visiontale Studio Inc. SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damages arising from your use or inability to use the App
  • Damages arising from errors, bugs, or technical issues
  • Damages caused by third-party services or content

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (CURRENTLY $0).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Visiontale Studio Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Technical or security reasons

14.3 Effect of Termination

Upon termination:

  • Your license to use the App immediately ends
  • You must cease all use of the App and delete it from your devices
  • Provisions that by their nature should survive (indemnification, limitations of liability, dispute resolution) will continue to apply

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date at the top of this document
  • Providing in-app notification for significant changes

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Dispute Resolution

16.1 Informal Resolution

16.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Visiontale Studio Inc. is incorporated, without regard to conflict of law principles.

16.3 Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits or class-wide arbitration.

16.4 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Visiontale Studio Inc. regarding the App.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.

17.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

17.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
